Today, the Texas Education Agency announced that the comment period for certain proposed Commissioner of Education Rule Filings will begin on February 5, 2016. The proposed new / amended Commissioner Rule Filings involve various provisions that will directly or indirectly affect the state aid funds received by school districts and open-enrollment charter schools. The upcoming new / amended proposed Commissioner of Education Rule filings include:
Proposed New 19 TAC Chapter 102, Educational Programs, Subchapter AA, Commissioner's Rules Concerning Early Childhood Education Programs, §102.1003, High-Quality Prekindergarten Grant Program
Summary: The proposed new rule would outline the requirements of a new grant program authorized by House Bill 4, 84th Texas Legislature, Regular Session, 2015.
Public Comment Period: February 5, 2016 - March 7, 2016.
Earliest Possible Date of Adoption: March 7, 2016.
Proposed Effective Date: April 10, 2016.
Proposed Amendment to 19 TAC Chapter 129, Student Attendance, Subchapter AA, Commissioner's Rules, §129.1025, Adoption by Reference: Student Attendance Accounting Handbook
Summary: The proposed amendment would adopt by reference the 2015-2016 Student Attendance Accounting Handbook.
Public Comment Period: February 5, 2016 - March 7, 2016.
Earliest Possible Date of Adoption: March 7, 2016.
Proposed Effective Date: April 24, 2016.
Proposed New 19 TAC Chapter 129, Student Attendance, Subchapter AA, Commissioner's Rules, §129.1031, Reporting Off-Campus Programs
Summary: The proposed new rule would reflect changes in statute made by House Bill 2812, 84th Texas Legislature, 2015.
Public Comment Period: February 5, 2016 - March 7, 2016.
Earliest Possible Date of Adoption: March 7, 2016.
Proposed Effective Date: April 17, 2016.

A request for a public hearing on a proposal submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register. Unforeseen circumstances may delay publication of the agency rules in the Texas Register. The Rules website will be updated to reflect any changes.
